1. Acceptance

By using MoodMark ("the App"), you agree to these Terms. If you do not agree, do not use the App.

2. Service Description

MoodMark provides:

• Daily mood tracking and colour calendar
• Science-backed habit tracking
• Insights into what affects your mood
• Personalised onboarding and habit recommendations

3. No Account Needed

Everything is stored on your device. No sign-up, no login, no password required.

4. Subscriptions

4.1 Requirement

A subscription is required to use MoodMark. Available plans include weekly and yearly subscriptions.

4.2 Free Trial

4.3 Billing

• Payment is charged to your Apple ID at purchase confirmation
• Subscriptions renew automatically unless cancelled at least 24 hours before the current period ends
• Renewal is charged within 24 hours before the period ends at the same price

4.4 Management & Cancellation

• Manage subscriptions: iOS Settings → Your Name → Subscriptions
• Cancellation takes effect at the end of the current billing period
• No refunds for unused portions of a subscription period

4.5 Refunds

All purchases are processed by Apple. Refund requests must be submitted through Apple, not us. All purchases are final unless Apple's refund policy applies.

5. User Responsibilities

You agree to:

• Use the App in compliance with applicable laws
• Not reverse engineer, decompile or exploit the App
• Not misuse the App for unintended purposes

We may restrict access if you violate these terms.

6. Age Requirements

MoodMark is intended for users aged 13 and over. Parents and guardians are responsible for minors using the App.

7. Third-Party Services

We do not sell your data, and we do not show ads inside the App. Tenjin helps us measure which of our own advertising campaigns bring people to MoodMark — see our Privacy Policy for what it receives and how to opt out.

8. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. We do not guarantee:

• That the App will meet your specific requirements
• Uninterrupted availability
• That the App will improve your mood or wellbeing
• Accuracy of any science-backed recommendations

The information provided in MoodMark is for general wellbeing purposes only and is not a substitute for professional medical or psychological advice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR:

• Indirect, incidental or consequential damages
• Loss of data or productivity
• Health or wellbeing decisions based on App data

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding any claim.

10. Intellectual Property

The App, including its design, code and content, is owned by MoodMark and protected by intellectual property laws. You may not copy, modify or distribute the App.

11. Termination

We may terminate or suspend your access for violation of these Terms. Upon termination, your right to use the App ends immediately.

12. Changes

We may modify these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be communicated within the App.

13. Governing Law

These Terms are governed by the laws of England and Wales. Disputes shall be resolved in the courts of England and Wales.

For EU consumers: You retain rights under consumer protection laws of your country of residence.

14. Apple App Store Terms

As required by Apple for App Store distribution:

• These Terms are between you and MoodMark, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide maintenance or support
• Apple is not responsible for any claims relating to the App
• Apple and its subsidiaries are third-party beneficiaries of these Terms
